Este artigo busca: a) apresentar uma introdução histórica ao direito natural clássico, apontando suas principais características; b) investigar em que medida tais ideias tem influenciado a filosofia do direito contemporânea, perquirindo, assim, se há atualidade no estudo daquelas antigas concepções. A partir das ideias clássicas, será possível estudar como autores contemporâneos como John Finnis as utilizam na construção de um renovado jusnaturalismo que dialoga criticamente com positivistas como Hart e Raz, demonstrando a atualidade de tal estudo ao sustentar a impossibilidade (...) de se descrever o direito de modo neutro ou avalorativo. O presente texto tem por objetivo demonstrar como a aplicação do positivismo presumido de Frederick Schauer contribui para o desenvolvimento do Estado Democrático de Direito a partir manutenção da separação de poderes, ao impedir a realocação de Poder especificamente no bojo do judiciário, quando este interpreta as regras de competência constitucionais. Assim, busca responder à seguinte pergunta: em que medida o positivismo presumido pode contribuir para impedir que juízes “sedentos por poder” alcancem seus objetivos?

Are the ideas of democracy and isonomy an absolute achievement of civilization, or just a tuning moment in a complex system of metamorphosis? Is this something universal or an aesthetic approach? Could our concept of art, in its deepest sense, be responsible for democracy? Or, could our concept of democracy exist because of art? This paper is a reflection on these questions. Normally, a scientific text should give answers but would this principle be universal? Inside our planetary metamorphosis all values (...) are changing as always but now at high speed. High speed gives us both the sensation of confusion, which was typical in other historical moments, as when Carmina Burana was elaborated in the Middle Ages, and the possibility to take a step back and have, in the eye of the cyclone, dynamic elements showing us change in process. A new type of neuronal cell was discovered a few years ago: the mirror neurons. Their existence is a disturbing fact for our conceptions of intelligence and memory, giving to the whole universe of mind understanding a new logical framework. The impact of such a discovery on our concept of aesthetics and philosophy of thought makes us to recall Peirce, Lupasco, Buckminster Fuller launching ourselves to field folds, the super-string model or black holes among other non-linear time and space complexes.

Este dossiê representa a continuidade de um projecto centrado no património dos agentes ligados à produção, circulação e recepção do livro. A partir da história e dos espólios de empresas editoriais e de coleccionadores, bibliófilos e/ou divulgadores, a introdução problematizante e os depoimentos convocam a memória dos agentes e debatem as ameaças que pendem sobre essa herança cultural riquíssima e possíveis soluções. As boas práticas de vários países impõem uma reflexão inadiável para o contexto português: que vias de cooperação inter-institucional (...) concretas para garantir o depósito, tratamento e comunica­ção duma dimensão fulcral do património e da memória colectiva. A relevância desta ques­tão deve-se a estar inextricavelmente ligada a um reconhecimento sustentável do estatuto patrimonial e histórico dos acervos dos editores e doutros agentes ligados à edição e ao livro enquanto espaços vitais para a construção da cultura impressa e para a história do livro e da edição. Este estudo visa a apresentar e analisar a Carta XXXVIII, de 1º de outubro de 1666, escrita por Espinosa. De conteúdo exclusivamente matemático, seu texto responde a uma questão de probabilidade aplicada a jogos de apostas em que é preciso preservar, para todos os jogadores, a mesma chance de ganhar. Para isso, apresentaremos o contexto histórico e exporemos detalhadamente o uso e o sentido da terminologia empregada por Espinosa ao longo de suas explicações. Emotional intelligence is a psychological skill that aids athletes in the control of emotions and optimization of sports performance. The present study investigated the psychometric properties of the Self-Report Emotional Intelligence Test in 508 Brazilian youth and adult athletes. Data analysis was conducted through Exploratory and Confirmatory Factor Analysis, Cronbach’s alpha, composite reliability and Pearson’s Correlation. EFA revealed the one-factor model with 26 items with the best adjustment. CFA confirmed the one-factor model with 26 items with best greater fit. No (...) evidence of invariance was found, suggesting that the SSEIT must be used with caution when comparing gender and age groups. The external validity was found in the correlation of EI and cognitive anxiety and self-confidence. It is concluded that the Brazilian version of SSEIT for the sports context presented acceptable psychometric properties, however, showed limitations that should be explored in the future. (shrink)

The belief in miracle, as a modality of spiritual/religious coping strategy in the face of stress and psychic suffering, has been discussed in psychological literature with regard to its positive or negative role on the health and well-being of patients and family members. In contemporary times, where pseudo-conflicts between religion and science should have been long overcome, there is still some tendency of interpreting belief in miracle – as the possibility of a cure granted by divine intervention, modifying the normal (...) course of events in a bleak medical diagnosis – as having unhealthy impacts in the care and treatment of health. This position seeks to find a base in the three characteristics of hoping in a miracle, frequently pointed out by psychological literature: it would imply a negation of reality instead of its confrontation; it would be a coping strategy focused on emotion instead of the problem; it would imply seeking to modify the supposed desire of God by extra-natural facts. In this study, we shall critically discuss this position and the dangers of its crystallization by the use of SRC scales in which the act of praying for a miracle is previously classified as a negative strategy. We revisit some tendencies in psychological literature about the subject, taking into consideration the various facets of miracle, sociocultural facts, elements of idiographic nature, and their profound outcomes in the lives of people especially in health contexts. We illustrate the dangers of a hasty generalization of the results of nomothetic studies about the role of belief in miracle with two examples of research in the Brazilian context: one carried out with pregnant women with fetal malformation and the other with family members caring for children and adolescents with cancer under chemotherapeutic treatment. In both studies, the results do not confirm the predominance of the negative aspects associated with the act of praying for a miracle, which we discuss and analyze in light of the phenomenological perspective. In this perspective, “pray for a miracle”, as experienced by patients and caregivers, can be recognized as an act of openness to life, bolstering hope, and the resignification of reality in the psyche. Although science is our most reliable producer of knowledge, it can also be used to create ignorance, unjustified doubt, and misinformation. In doing so, agnotological practices result not only in epistemic harms but also in social ones. A way to prevent or minimise such harms is to impede these ignorance-producing practices. In this paper, I explore various challenges to such a proposal. I first argue that reliably identifying agnotological practices in a way that permits the prevention of relevant harms is (...) more difficult than it might appear. I focus on an identifying criterion that many find apt for the task: bad faith motives. I then consider an objection—that reliable criteria are unnecessary to successfully address the concerns raised by agnotological strategies—and I show that it fails. I conclude by exploring other ways of conceptualising the problems attributed to agnotological practices. In particular, I challenge the focus on misinformation as the main problem of concern. The therapeutic misconception has been seen as presenting an ethical problem because failure to distinguish the aims of research participation from those receiving ordinary treatment may seriously undermine the informed consent of research subjects. Hence, most theoretical and empirical work on the problems of the therapeutic misconception has been directed to evaluate whether, and to what degree, this confusion invalidates the consent of subjects. We argue here that this focus on the understanding component of informed consent, while important, might be (...) too narrow to capture the ethical complexity of the therapeutic misconception. We show that concerns about misplaced trust and exploitation of such trust are also relevant, and ought to be taken into account, when considering why the therapeutic misconception matters ethically. Soren Kierkegaard's Works of Love, a series of deliberations on the commandment to love one's neighbor, has often been condemned by critics. Here, Ferreira seeks to rehabilitate Works of Love as one of Kierkegaard's most important works. He shows that Kierkegaard's deliberations on love are highly relevant to some important themes in contemporary ethics, including impartiality, duty, equality, mutuality, reciprocity, self-love, sympathy, and sacrifice. Ferreira also argues that Works of Love bears on issues peculiar to a religious ethic, (...) such as the role of God as "middle term," and the possibility of preserving the aesthetic dimensions of love in a religious ethic of relation. It is widely held that all lies are assertions: the traditional definition of lying entails that, in order to lie, speakers have to assert something they believe to be false. It is also widely held that assertion contrasts with presupposition and, in particular, that one cannot assert something by presupposing it. Together, these views imply that speakers cannot lie with presuppositions—a view that Andreas Stokke has recently explicitly defended. The aim of this paper is to argue that speakers can lie (...) with presuppositions, and to discuss some of the implications this outcome has for current research on lying, assertion and presupposition. The distinction between lying and mere misleading is commonly tied to the distinction between saying and conversationally implicating. Many definitions of lying are based on the idea that liars say something they believe to be false, while misleaders put forward a believed-false conversational implicature. The aim of this paper is to motivate, spell out, and defend an alternative approach, on which lying and misleading differ in terms of commitment: liars, but not misleaders, commit themselves to something they believe to be (...) false. This approach entails that lying and misleading involve speech-acts of different force. While lying requires the committal speech-act of asserting, misleading involves the non-committal speech-act of suggesting. The approach leads to a broader definition of lying that can account for lies that are told while speaking non-literally or with the help of presuppositions, and it allows for a parallel definition of misleading, which so far is lacking in the debate. Because rate of force development is an emerging outcome measure for the assessment of neuromuscular function in unfatigued conditions, and it represents a valid alternative/complement to the classical evaluation of pure maximal strength, this scoping review aimed to map the available evidence regarding RFD as an indicator of neuromuscular fatigue. Thus, following a general overview of the main studies published on this topic, we arbitrarily compared the amount of neuromuscular fatigue between the “gold standard” measure and peak, early and late (...) RFD. Seventy full-text articles were included in the review. The most-common fatiguing exercises were resistance exercises, endurance exercises/locomotor activities, isokinetic contractions, and simulated/real sport situations. The most widely tested tasks were knee extension and plantar flexion. The reason for evaluating RFD was lacking in 36% of the studies. On average, the amount of fatigue for MVF was comparable to late RFD but lower compared to both peak RFD and early RFD. Even if the rationale for evaluating RFD in the fatigued state was often lacking and the specificity between test task and fatiguing exercise characteristics was not always respected in the included studies, RFD seems to be a valid indicator of neuromuscular fatigue. Based on our arbitrary analyses, peak RFD and early phase RFD appear even to be more sensitive to quantify neuromuscular fatigue than MVF and late phase RFD. (shrink)

Este trabalho apresenta algumas considerações do pensador italiano Gianni Vattimo acerca da religião na idade contemporânea. O referido filósofo tem como base de suas reflexões a ideia de uma filosofia pós-moderna que se caracteriza pela desconstrução da metafísica da tradição moderna. Nesse sentido, o autor visualiza nas filosofias de Nietzsche e Heidegger a inauguração de uma nova orientação do pensamento ocidental, marcada por esse rompimento com as filosofias totalizantes e pela consideração do ser como resultado das circunstancias eventuais que compõem (...) a experiência existencial. A religião, por sua vez, não acompanhou tal movimento, mas conservou um pensamento marcado ainda pela estrutura da metafísica tradicional, por isso, não se encontra em condições de responder às atuais demandas deste mundo plural. O autor sinaliza para a necessidade da abdicação das estruturas dogmáticas e dos fundamentalismos da religião como meio para a abertura ao diálogo inter-religioso e intercultural. (shrink)

The increasing use of digital technologies in judicial and arbitration proceedings increases the usage of digital evidence by the parties, which brings the necessity of creating patterns for adjudicators to admit and assess this new type of evidence. This paper generally addresses digital evidence focusing on the second moment in international arbitration proceedings. It also narrows the topic to hacked and leaked evidence and its admissibility in international arbitration. The literature review showed a significant amount of research devoted to the (...) evidence in arbitration. Some considered electronic evidence within one jurisdiction; others focused on certain forms of digital evidence such as electronic signatures. Papers on digital evidence in international arbitration approach arbitration rules for digital evidence but skip admissibility issues. No systemic and complex works research digital evidence in arbitration, explicitly focusing on the admissibility of hacked and leaked digital evidence from a comparative perspective. Also, no research deals with enforcing international arbitration awards relying on illegally obtained digital evidence. In these cases, there could be a possible violation of domestic public policy under the New York Convention terms (art. V, 2, b). That is why the paper aims to offer the concept of digital evidence in international arbitration, including hacked and leaked evidence, criteria of its admissibility and relevance, and design the arbitration guidelines for assessing hacked and leaked evidence. Comparative legal analysis of the international arbitration rules and national procedure law allowed us to compare the regulatory approaches to the definition of digital evidence and its admissibility worldwide. The method of legal modeling allowed designing model guidelines for arbitral tribunals to evaluate the admissibility and relevance of digital evidence, including hacked and leaked evidence. Moreover, the case study method allowed us to analyze jurisprudence and define criteria for admission of hacked and leaked evidence. We conclude that the admissibility of hacked and leaked evidence depends solely on the arbitrator’s broad discretion to assess the evidence. Nevertheless, thorough evidence analysis and a well-reasoned award are always mandatory. (shrink)

It is argued here that bioethicists might inadvertently be promoting genetic determinism: the idea that genes alone determine human traits and behaviours. Discussions about genetic testing are used to exemplify how they might be doing so. Quite often bioethicists use clinical cases to support particular moral obligations or rights as if these cases were representative of the kind of information we can acquire about human diseases through genetic testing, when they are not. On other occasions, the clinical cases are presented (...) in simplistic ways that portray genetic testing as yielding information more accurate than it actually is. It is concluded that, because of the problematic implications that the ideology of genetic determinism might have for individuals’ wellbeing and for our public policies, bioethicists should be careful to present these issues in ways that do not promote questionable ideas about the causal role of genes in human diseases and behaviours. While various definitions of moral distress have been proposed, some agreement exists that it results from illegitimate constraints in clinical practice affecting healthcare professionals’ moral agency. If we are to reduce moral distress, instruments measuring it should provide relevant information about such illegitimate constraints. Unfortunately, existing instruments fail to do so. We discuss here several shortcomings of major instruments in use: their inability to determine whether reports of moral distress involve an accurate assessment of the requisite clinical and logistical facts (...) in play, whether the distress in question is aptly characterized as moral, and whether the moral distress reported is an appropriate target of elimination. Such failures seriously limit the ability of empirical work on moral distress to foster appropriate change. (shrink)

The argument from inductive risk has been embraced by many as a successful account of the role of values in science that challenges the value-free ideal. We argue that it is not obvious that the argument from inductive risk actually undermines the value-free ideal. This is because the inductive risk argument endorses an assumption held by proponents of the value-free ideal: that contextual values never play an appropriate role in determining evidence. To understand the endogenous components of the event-related brain potential (ERP), we must use data about the components' antecedent conditions to form hypotheses about the information-processing function of the underlying brain activity. These hypotheses, in turn, generate testable predictions about the consequences of the component. We review the application of this approach to the analysis of the P300 component. The amplitude of the P300 is controlled multiplicatively by the subjective probability and the task relevance of the eliciting events, whereas its (...) latency depends on the duration of stimulus evaluation. These and other factors suggest that the P300 is a manifestation of activity occurring whenever one's model of the environment must be revised. Tests of three predictions based on this “context updating” model are reviewed. Verleger's critique is based on a misconstrual of the model as well as a partial and misleading reading of the relevant literature. (shrink)

We analyze recent criticisms of the use of hyperreal probabilities as expressed by Pruss, Easwaran, Parker, and Williamson. We show that the alleged arbitrariness of hyperreal fields can be avoided by working in the Kanovei–Shelah model or in saturated models. We argue that some of the objections to hyperreal probabilities arise from hidden biases that favor Archimedean models. We discuss the advantage of the hyperreals over transferless fields with infinitesimals. In Paper II we analyze two underdetermination theorems by Pruss and (...) show that they hinge upon parasitic external hyperreal-valued measures, whereas internal hyperfinite measures are not underdetermined. The lack of public support for climate change policies and refusals to vaccinate children are just two alarming illustrations of the impacts of dissent about scientific claims. Dissent can lead to confusion, false beliefs, and widespread public doubt about highly justified scientific evidence. Even more dangerously, it has begun to corrode the very authority of scientific consensus and knowledge. Deployed aggressively and to political ends, some dissent can intimidate scientists, stymie research, and lead both the public and policymakers to oppose (...) important public policies firmly rooted in science. -/- To criticize dissent is, however, a fraught exercise. Skepticism and fearless debate are key to the scientific process, making it both vital and incredibly difficult to characterize and identify dissent that is problematic in its approach and consequences. Indeed, as de Melo-Martín and Intemann show, the criteria commonly proposed as means of identifying inappropriate dissent are flawed and the strategies generally recommended to tackle such dissent are not only ineffective but could even make the situation worse. -/- The Fight Against Doubt proposes that progress on this front can best be achieved by enhancing the trustworthiness of the scientific community and by being more realistic about the limits of science when it comes to policymaking. It shows that a richer understanding of the context in which science operates is needed to disarm problematic dissent and those who deploy it. Dieses Buch bietet die erste systematische Interpretation von Husserls Ideen für eine reine Phänomenologie und phänomenologische Philosophie anhand der neuen kritischen Edition von Ideen II. Es ermöglicht eine phänomenologische Auslegung des allgemein-metaphysischen Problems, wie physische, mentale und soziale Tatsachen zusammenhängen. Das Buch diskutiert und interpretiert detailliert einige von Husserls zentralen Konzeptionen und zeigt die Konsequenzen seines Denkansatzes und seiner Theorieentwicklung. Natur und Gemeingeist sind Husserl zufolge die Grundbegriffe der naturalistischen und der personalistischen Einstellungen und dienen als Leitfaden der Unterscheidung zwischen (...) Natur- und Geisteswissenschaften. In der kritischen Auseinandersetzung mit diesem wissenschaftstheoretischen Dualismus führt Husserl den Habitus-Begriff methodisch ein, um das Verhältnis von Natur- und Sozialontologie aus der konkreten Erfahrung heraus phänomenologisch neu zu deuten, womit der spätere, anti-dualistische Weg der Lebensweltphänomenologie vorbereitet wird. In Husserls Studien zur Regionalontologie des Gemeingeistes rückt das konkrete Subjekt in den Vordergrund der Intentionalitätsanalyse, indem die sinntragenden Elemente der Inaktualitität auf Habitualisierungsprozesse und die Intersubjektivität auf Sozialisierungsstufen zurückgeführt werden. Dank der durch den Habitus-Begriff ermöglichten klaren Unterscheidung zwischen konstituierender Aktualität und konstitutiver Relevanz des inaktuellen Horizonts kann Husserls Philosophie des Geistes als individualistisch und holistisch zugleich gelten. Dieser ontologischen Position entspricht auch Husserls sozialepistemologische Ansicht, dass sich Wissenschaften erst im Rahmen idealisierter Sozialstrukturen entfalten können. Durch diese idealisierenden Operationen wird die Konstitution der Objektivität möglich, welche die Wissenschaften anstreben. Deren Rationalität ist deshalb in ihren konkreten und idealisierten Sozialitätsstufen und Habitualitäten zu befragen. (shrink)

Philosophers of science, particularly those working on science and values, often talk about the need for science to be socially responsible. However, what this means is not clear. In this paper, we review the contributions of philosophers of science to the debate over socially responsible science and explore the dimensions that a fruitful account of socially responsible science should address. Our review shows that offering a comprehensive account is difficult. We contend that broad calls for socially responsible science that fail (...) to attend to relevant dimensions are not the solution, as they preclude meaningful changes to research institutions and practices. We conclude that narrower, more explicit accounts are more likely to lead to substantive transformation. (shrink)

Resumo: Este artigo possui o propósito de colocar à prova a interpretação heideggeriana acerca das noções nietzschianas de vontade de potência e eterno retorno do mesmo. Para levar a cabo o referido objetivo, de início, apresentaremos o argumento desenvolvido por Heidegger nas suas preleções e textos sobre Nietzsche, editadas e publicadas em dois volumes, no ano de 1961. Num segundo momento, examinaremos, em Nietzsche: sua filosofia dos antagonismos e os antagonismos de sua filosofia, a resposta que Müller-Lauter ofereceu à crítica (...) de Heidegger. Por ocasião deste exame, tentaremos salientar que haveria certa insuficiência na réplica deste comentador. Por fim, iremos recorrer aos textos do próprio Nietzsche para tentar promover uma confrontação com a interpretação do Filósofo da Floresta Negra.: This article has the purpose to challenge the Heideggerian interpretation of Nietzsche’s notions of will to power and eternal recurrence. To carry out this objective, we will first present the argument developed by Heidegger in his lectures and texts on Nietzsche, edited and published in two volumes, in 1961. In a second moment, we will examine, in Nietzsche: his philosophy of antagonisms and the antagonisms of his philosophy, the answer that Müller-Lauter offered to Heidegger’s criticism. On the occasion of this examination, we will try to point out that there would be a certain insufficiency in this commenter’s reply. Finally, we will resort to Nietzsche’s own texts to try to promote a confrontation with the Black Forest Philosopher’s interpretation. (shrink)

Drawing on evolutionary epistemology, process ontology, and a social-cognition approach, this book suggests cognitive evolution, an evolutionary-constructivist social and normative theory of change and stability of international social orders. It argues that practices and their background knowledge survive preferentially, communities of practice serve as their vehicle, and social orders evolve. As an evolutionary theory of world ordering, which does not borrow from the natural sciences, it explains why certain configurations of practices organize and govern social orders epistemically and normatively, and (...) why and how these configurations evolve from one social order to another. Suggesting a multiple and overlapping international social orders' approach, the book uses three running cases of contested orders - Europe's contemporary social order, the cyberspace order, and the corporate order - to illustrate the theory. Based on the concepts of common humanity and epistemological security, the author also submits a normative theory of better practices and of bounded progress. (shrink)

In this paper we show how some reasoning, though fallacious, can appear to be attractive and useful for beings-like-us. Although they do not provide conclusive evidence to support or reject a certain claim the way scientific statements do, they tell us something interesting about how humans build up their arguments and reasons. First of all, we will consider and investigate three main types of fallacies: argumentum ad hominem, argumentum ad verecundiam, and argumentum ad populum. These three fallacies are traditionally considered (...) as examples of a broader category called ignoratio elenchi. Secondly, we show how people who commit these fallacies rely on information about other human beings in their reasoning. That is, they do not follow certain logical procedures that eventually lead them to correct conclusions. But they simply make use of others as social characters. For example, being an authority, being an expert, being part of a class, etc., become the substitutes for more direct evidence to support a certain claim or to make an argument more appealing. Many recent definitions of lying are based on the notion of what is said. This paper argues that says-based definitions of lying cannot account for lies involving non-literal speech, such as metaphor, hyperbole, loose use or irony. It proposes that lies should instead be defined in terms of assertion, where what is asserted need not coincide with what is said. And it points to possible implications this outcome might have for the ethics of lying.

ABSTRACTA probability model is underdetermined when there is no rational reason to assign a particular infinitesimal value as the probability of single events. Pruss claims that hyperreal probabilities are underdetermined. The claim is based upon external hyperreal-valued measures. We show that internal hyperfinite measures are not underdetermined. The importance of internality stems from the fact that Robinson’s transfer principle only applies to internal entities. We also evaluate the claim that transferless ordered fields may have advantages over hyperreals in probabilistic modeling. (...) In Emanuel Adler's distinctive constructivist approach to international relations theory, international practices evolve in tandem with collective knowledge of the material and social worlds. This book - comprising a selection of his journal publications, a new introduction and three previously unpublished articles - points IR constructivism in a novel direction, characterized as 'communitarian'. Adler's synthesis does not herald the end of the nation-state; nor does it suggest that agency is unimportant in international life. Rather, it argues that what mediates (...) between individual and state agency and social structures are communities of practice, which are the wellspring and repositories of collective meanings and social practices. The concept of communities of practice casts new light on epistemic communities and security communities, helping to explain why certain ideas congeal into human practices and others do not, and which social mechanisms can facilitate the emergence of normatively better communities. In this paper I will discuss some issues related to a recent trend in experimental philosophy (or x-phi), and try to show the reasons of its late (and scarce) involvement with aesthetics, compared to other areas of philosophical investigation. In order to do this, it is first necessary to ask how an autonomous experimental philosophy of aesthetics could be related to the long-standing tradition of psychological experimental aesthetics. After distinguishing between a “narrow” and a “broad” approach of experimental philosophy, I (...) will then make a distinction between topics in aesthetics pertaining to perceptual and cognitive processes, and traditional issues involved in the analysis of general and culturally-laden concepts. The narrow program of experimental philosophy, focused on the investigation of folk intuitions, is particularly effective only when two general conditions are met: the use of hypothetical scenarios (testing of thought experiments) and the heuristic role of folk intuitions in drawing philosophically relevant conclusions. I will argue that, when aesthetics is concerned, these requirements are not easily met. These difficulties notwithstanding, I will support a pluralistic view where aesthetics is revealed as an instructive example of how experimental approaches and traditional “armchair” philosophy integrate, and enrich each other. Dieses Buch bietet die erste systematische Interpretation von Husserls Ideen für eine reine Phänomenologie und phänomenologische Philosophie anhand der neuen kritischen Edition von Ideen II. Es ermöglicht eine phänomenologische Auslegung des allgemein-metaphysischen Problems, wie physische, mentale und soziale Tatsachen zusammenhängen. Das Buch diskutiert und interpretiert detailliert einige von Husserls zentralen Konzeptionen und zeigt die Konsequenzen seines Denkansatzes und seiner Theorieentwicklung. Natur und Gemeingeist sind Husserl zufolge die Grundbegriffe der naturalistischen und der personalistischen Einstellungen und dienen als Leitfaden der Unterscheidung zwischen (...) Natur- und Geisteswissenschaften. In der kritischen Auseinandersetzung mit diesem wissenschaftstheoretischen Dualismus führt Husserl den Habitus-Begriff methodisch ein, um das Verhältnis von Natur- und Sozialontologie aus der konkreten Erfahrung heraus phänomenologisch neu zu deuten, womit der spätere, anti-dualistische Weg der Lebensweltphänomenologie vorbereitet wird. In Husserls Studien zur Regionalontologie des Gemeingeistes rückt das konkrete Subjekt in den Vordergrund der Intentionalitätsanalyse, indem die sinntragenden Elemente der Inaktualitität auf Habitualisierungsprozesse und die Intersubjektivität auf Sozialisierungsstufen zurückgeführt werden. Dank der durch den Habitus-Begriff ermöglichten klaren Unterscheidung zwischen konstituierender Aktualität und konstitutiver Relevanz des inaktuellen Horizonts kann Husserls Philosophie des Geistes als individualistisch und holistisch zugleich gelten. Dieser ontologischen Position entspricht auch Husserls sozialepistemologische Ansicht, dass sich Wissenschaften erst im Rahmen idealisierter Sozialstrukturen entfalten können. Durch diese idealisierenden Operationen wird die Konstitution der Objektivität möglich, welche die Wissenschaften anstreben. Deren Rationalität ist deshalb in ihren konkreten und idealisierten Sozialitätsstufen und Habitualitäten zu befragen. (shrink)

In this paper we show how some reasoning, though fallacious, can appear to be attractive and useful for beings-like-us. Although they do not provide conclusive evidence to support or reject a certain claim the way scientific statements do, they tell us something interesting about how humans build up their arguments and reasons. First of all, we will consider and investigate three main types of fallacies: argumentum ad hominem , argumentum ad verecundiam , and argumentum ad populum . These three fallacies (...) are traditionally considered as examples of a broader category called ignoratio elenchi. Secondly, we show how people who commit these fallacies rely on information about other human beings in their reasoning. That is, they do not follow certain logical procedures that eventually lead them to correct conclusions. But they simply make use of others as social characters. For example, being an authority, being an expert, being part of a class, etc., become the substitutes for more direct evidence to support a certain claim or to make an argument more appealing. Em sede de objetivo geral pretende-se elucidar a partir de teóricos decoloniais sobre o neoliberalismo, as justificativas desenvolvimentistas, respondendo a seguinte pergunta de pesquisa: em que medida a concepção neoliberalista, abarcadas pelo Estado Brasileiro, configurou a atmosfera de conflitos socioambientais que se apresenta na atualidade da Amazônia brasileira? O método utilizado é o exploratório-indutivo, com estudo bibliográfico. Como principais resultados, tem-se na literatura de pesquisa da Amazônia sobre megaprojetos da (COSTA,2012; ACEVEDO MARÍN, 2017; Marin e Maia, 2018; LOUREIRO,2010;SILVA,2020, 2022) a (...) observância da deterioração das bases sociais nos territórios dos municípios afetados, e esta decorre da ausência de um planejamento mínimo para as pequenas cidades que sofrem com a migração, aumento brusco da população e ausência de infraestrutura mínima para a sobrevivência digna, alterando de forma negativa seu modo de vida. In diesem Essay wird mit den Mitteln der Sprachphilosophie ge­zeigt, dass vermutende Sprechakte für die Krisenkommunikation in der Corona-Pandemie richtig und wichtig sind. Weder sind Vermutungen anfälliger für Unklarheit als andere Sprechakte noch sind sie besser dazu geeignet, Verantwortung abzuweisen. Im Gegen­teil: In einer Situation, die durch Unsicherheit geprägt ist, sind Vermutungen besonders wertvoll für das (...) Kommunizieren ungesicherter Hypothesen. (shrink)

In the past few years, machine learning (ML) tools have been implemented with success in the medical context. However, several practitioners have raised concerns about the lack of transparency—at the algorithmic level—of many of these tools; and solutions from the field of explainable AI (XAI) have been seen as a way to open the ‘black box’ and make the tools more trustworthy. Recently, Alex London has argued that in the medical context we do not need machine learning tools to be (...) interpretable at the algorithmic level to make them trustworthy, as long as they meet some strict empirical desiderata. In this paper, we analyse and develop London’s position. In particular, we make two claims. First, we claim that London’s solution to the problem of trust can potentially address another problem, which is how to evaluate the reliability of ML tools in medicine for regulatory purposes. Second, we claim that to deal with this problem, we need to develop London’s views by shifting the focus from the opacity of algorithmic details to the opacity of the way in which ML tools are trained and built. We claim that to regulate AI tools and evaluate their reliability, agencies need an explanation of how ML tools have been built, which requires documenting and justifying the technical choices that practitioners have made in designing such tools. This is because different algorithmic designs may lead to different outcomes, and to the realization of different purposes. However, given that technical choices underlying algorithmic design are shaped by value-laden considerations, opening the black box of the design process means also making transparent and motivating (technical and ethical) values and preferences behind such choices. Using tools from philosophy of technology and philosophy of science, we elaborate a framework showing how an explanation of the training processes of ML tools in medicine should look like. (shrink)
